U.S. Ninth Circuit Strikes Down Idaho’s Ag Gag Law

Mercy for Animals Protest

The U.S. Court of Appeals for the Ninth Circuit ruled that Idaho’s ag gag law that criminalized the making of undercover videos at agricultural facilities violates the First Amendment. The case stemmed from a 2012 undercover operation by Mercy for Animals at Bettencourt Dairies that exposed animal cruelty and led to criminal charges against workers. In response, industry advocates pursued the bill, SB 1337, that would make it a crime to take photos or video at a factory farm without the owner’s permission.
